MISCELLANEOUS

The National Ice Centre to be considered valid. A waiver of any provision hereunder
shall not operate as a waiver of any other provision, or a continuing waiver of
the same provision in the future. If any court of competent jurisdiction finds any
provision of these terms to be void or unenforceable for any reason then such provision
shall be ineffective to the extent of the court’s finding without affecting the
validity and enforceability of any remaining provisions. These terms represent the
entire understanding and agreement between the parties relating to the subject matter
herein and supersede any and all prior statements, understandings or agreements
whether oral or written, and shall not be modified except in writing, signed by
you and on behalf of The National Ice Centre.
TICKETS & EVENTS
- The tickets purchased are for your own personal use only and may not be transferred
or re-sold to any other person or body under any circumstances or used as part of
any promotion or competition or for commercial gain. Where there has been any re-sale
or attempted re-sale of any tickets (or any other breach of this term), we reserve
the right to cancel the relevant tickets with immediate effect and refuse admission
to the concert using that ticket.
- We reserve the right to cancel any ticket purchase made by any person whom we reasonably
believe to be associated with any ticket broker or tout.
- To enter the venue on the day of the event, each original purchaser and any person
accompanying him/her to the show must be present at the venue on the night of the
show. There are no exceptions to this.
- Upon arrival at the venue each original purchaser must present the actual credit/debit
card used for the purchase along with their tickets and receipt in order to gain
entry to the venue. Failure to present the valid card and receipt may cause you
to be refused entry to the event.
- Whilst we allocate specific seats to you the venue has the right to change these
seats to others of equal value.
- There will be no exceptions to the above, no name changes or letters of authorisation
will be accepted under any circumstances.
- The original conditions of sale will be enforced. Tickets are non-transferable under
any circumstances and any resale or transfer, or attempted resale or transfer, will
invalidate any ticket purchase made.
- When tickets are being collected at the box office, we ask that the cardholder presents
the card that the tickets were booked on as identification. Any other forms of i.d.
or letters of authorization are taken at your own risk and may result in the tickets
being withheld at the box office.
- In the event that your tickets are lost in the post and duplicates are arranged
for collection at the box office, these will only be given out to the cardholder
upon production of the card that was used to make the booking.
- Once purchased, tickets cannot be transferred, exchanged, refunded or returned unless
the event is cancelled, moved to another date, or if details of the event are significantly
changed after an order is placed (significant changes being a change of headline
act (concerts only), venue or show time).
- • In the event of the cancellation of an event by the organiser/promoter (ie a cancellation
due to circumstances beyond The National Ice Centre's control), beyond The National
Ice Centre will only refund the face value of the ticket. The National Ice Centre
will use best endeavours to contact purchasers either by phone, email or in writing
(using the details provided at the time of ordering) and advise them to return the
tickets. Please note, however, it is the customer's responsibility to check whether
the event is going ahead at the scheduled date, time and venue, and The National
Ice Centre cannot guarantee that they will inform the customer of any changes to
the event date, time or venue.

We advise the use of secure mail when returning tickets. On receipt, The National
Ice Centre will refund the customer the face value of the tickets using the same
method as used to purchase them.
If an event is moved from its advertised venue and / or the date is changed, tickets
already purchased may remain valid should the customer wish to attend the revised
event. If not, The National Ice Centre will refund the face value of the tickets.

In the event of a change at short notice (within 1 week of the event) The National
Ice Centre will notify purchasers of the conditions that apply, and offer a refund
if these are not agreeable. Please note, however, it is the customer's responsibility
to check whether the event is going ahead at the scheduled date, time and venue,
and The National Ice Centre cannot guarantee that they will inform the customer
of any changes to the event date, time or venue.
If The National Ice Centre is unable to fulfil an order for any of the reasons below
the customer will be entitled to a full refund, including any booking fee charged:
- The National Ice Centre do not receive the tickets for your order from the event
organiser, and cannot arrange for the tickets to be collected
- The National Ice Centre despatch your order to the wrong address and cannot provide
replacement tickets
- The National Ice Centre do not despatch your order and do not arrange for the tickets
to be available for collection
- The National Ice Centre despatch the wrong order, ie wrong event / wrong type of
tickets
- Any other similar circumstances where The National Ice Centre has acted with negligence
or where we may have acted in breach of contract
- No duplicate tickets will be issued to replace lost or stolen tickets.
- Customers are advised to check their purchase upon receipt.
It is the responsibility of the customer to inform The National Ice Centre of any
change of address, contact phone number or email address, both before and after
receipt of the goods. Please note that our preferred method of contact for customers
booking online is by email, so care should be taken to provide a current, valid
email address.
The right to admission to an event is reserved by the promoter and event venue,
who may take health and safety, environmental and security concerns into account
at their reasonable discretion, and may from time to time carry out security searches.
The National Ice Centre would advise customers that no refunds will be offered to
customers who are refused entry or ejected from a venue on account of late arrival,
being (or appearing to be) under age*, declining to be searched, abusive, threatening,
drunken or other antisocial behaviour (including smoking in no smoking areas), carrying
offensive weapons or illegal substances, or making unauthorised audio, video or
photographic recordings.
*Events and ticket types where an age restriction applies are clearly indicated
during the booking process. Please ensure that you read all the information that
applies to the event/ticket you are booking, and carry proof of age if appropriate.
If it becomes impractical to post tickets out, due to the proximity of an event
or circumstances beyond our control, we reserve the right to make tickets available
for collection at the venue immediately prior to the event. Customers will be notified
by phone, email or in writing (using the details provided at the time of ordering)
if this becomes necessary.
By ordering you agree that the tickets are for the personal use of you and your
party only, and will not be resold or transferred. Any resale or attempt to resell
the tickets at a price higher than purchased will result in your orders being cancelled
without prior notification.
If a customer orders more tickets than the maximum allowed, as indicated during
the booking process, we reserve the right to cancel the order. The maximum applies
per person/card/household.
If tickets that are despatched are returned to The National Ice Centre as "Address
unknown", “Return to Sender” or similar we reserve the right to cancel the order.
In order to prevent fraud and to protect both parties, you may be asked to provide
additional information after your booking so that we can verify your purchase.
We reserve the right to cancel any order that further to investigation we deem to
be possibly of a fraudulent nature. These checks may include, but not be limited
to, a request to be provided with an original credit or debit card statement, attempts
to contact a customer by telephone, reference to records to check for other fraudulent
activity at an address.
We will not share your personal information for marketing or any other purposes
without your consent unless where required by law.

relevant promotions, offers or information that you have expressed an interest in
or that might be of interest to you.

RETAIL TERMS & CONDITIONS
Definitions
- 1.1 "Customer" means the individual or company to whom these terms are addressed
- 1.2 "Force Majeure" means any cause affecting the performance by the National Ice
Centre of its obligations arising from acts, events, omissions, happenings or non-happenings
beyond its reasonable control including (but not limited to) governmental regulations,
fire, flood or any disaster or industrial dispute affecting a third party.
- 1.3 "Normal Working Hours" means 9 am to 5 pm on a Working Day.
- 1.4 "Working days" means Monday to Friday, excluding Bank or other Public holidays.
Orders
- 2.1 All contracts of sale made by the National Ice Centre shall be deemed to incorporate
these terms and conditions, which shall prevail over any other terms from the party
("the Customer") with whom the National Ice Centre is dealing. Cancellation of orders
by Consumers will be accepted in accordance with the Consumer Protection (Distance
Selling) Regulations 2000. Nothing in these terms and conditions is intended to
impinge upon a Consumer's statutory or contractual rights to reject faulty goods.
- 2.2 All orders are subject to acceptance and to availability of the goods ordered:
The National Ice Centre is entitled to refuse any order placed by you.
- 2.3 You undertake that:
- 2.3.1 all details you provide to us for the purpose of purchasing goods or services
offered on our web site are correct, and
- 2.3.2 the credit or debit card you use to make a purchase from us is your own card
or your company's card, that you are authorised to use it, and that there are sufficient
funds or credit facilities to cover the cost of any goods or services you order
from us. We reserve the right to obtain validation of your credit or debit card
details before providing you with any goods or services.
Prices
- 3.1 Goods and services, together with VAT, are invoiced at the price prevailing
at time of order.
- 3.2 All prices are quoted and transactions made in Pounds Sterling.
- 3.3 The National Ice Centre reserves the right to modify the prices from time to
time.
Delivery, Title and Risk
- 4.1 The National Ice Centre shall use reasonable endeavours to despatch goods within
a reasonable timeframe, but does not accept liability for failure to deliver within
the stated time where this is caused by circumstances beyond our reasonable control,
such as delays caused by delivery companies.
- 4.2 Delivery is deemed to take place when the goods are delivered to the Customer's
address, whereupon the risks of loss, breakage and all damage and all other risks
shall pass to the Customer.
- 4.3 Title in the goods does not pass to the Customer until payment is received in
full by the National Ice Centre.
Collection
Payment
- 5.1 Payment is due on purchase.
Product specifications
- 6.1The National Ice Centre makes every effort to supply the goods as advertised
- 6.2If the National Ice Centre cannot supply the goods ordered by the Customer, the
National Ice Centre reserves the right to offer goods of equal or superior quality
at no extra cost. In such a case, if the Customer does not wish to accept the alternative
goods offered, he or she may cancel the order and require the refund of any money
paid to the National Ice Centre in respect of that order, including carriage charges.
This shall be the sole remedy of the Customer in these circumstances.
The Consumer Protection (Distance Selling) Regulations 2000
- 7.1 Contracts for the purchase of goods by a Customer not acting in the course of
a business and through the National Ice Centre website, or by mail order, are subject
to The Consumer Protection (Distance Selling) Regulations 2000 ('the Regulations').
- 7.2 Customers may cancel goods purchased from the National Ice Centre by sending
a written notice of cancellation by email to shopmail@national-ice-centre.com, or
by mail to The Arena Sports Shop, The National Ice Centre, Bolero Square, The Lace
Market, Nottingham, NG1 1LA.
- 7.3 The notice of cancellation must be delivered within 7 working days of the day
of purchase.
- 7.4 The Customer will be responsible for the cost of returning the goods if he or
she exercises this right of cancellation under the Regulations. If the Customer
does not actually return the goods to the National Ice Centre, the Customer is under
a duty to make the goods available for collection at the Customer's expense from
the address to which they were delivered.
- 7.5 The Customer is under a duty to retain possession of the goods whilst awaiting
return to the National Ice Centre and to take reasonable care of them during this
period. The Customer will be liable for any loss of or damage to the goods if he
or she fails to comply with this obligation.
Errors and Omissions
- 8.1 The National Ice Centre makes every effort to ensure that all prices and descriptions
quoted on its website are correct and accurate. However, the frenetic tempo of e-commerce
makes it inevitable that mistakes will occasionally occur. In the case of a manifest
error or omission, the National Ice Centre will be entitled to rescind the contract,
notwithstanding that it has already accepted the Customer's order and/or received
payment from the Customer. The National Ice Centre’s liability in that event will
be limited to the return of any money the Customer has paid in respect of the order.
In the case of a manifest error in relation to price, the Customer will be entitled
to purchase the goods by paying the difference between the quoted price and the
correct price, as confirmed in writing by the National Ice Centre after the manifest
error has been discovered.
- 8.2 A 'manifest error', as the term is used in sub-paragraph (1) above, means, in
relation to an incorrect price, a price quoted in error by the National Ice Centre
which is more than 10% less than the price that would have been quoted had the mistake
not been made.
General
- 9.1 Nothing in these terms and conditions affects your statutory rights as a Consumer.
- 9.2 If any provision in this Agreement is held to be invalid or unenforceable, it
shall be deemed severed from the Agreement and this shall not affect the validity
or enforceability of the remaining provisions.
- 9.3 Any waiver of a breach of this Agreement must be in writing.
- 9.4 Any variation of this Agreement must be in writing and signed by a duly authorised
the National Ice Centre official.
- 9.5 The headings are for convenience only and shall not affect the interpretation
of this Agreement.
- 9.6 Any notices given under this Agreement shall be in writing and sent (a) by first
class pre-paid post to the last known address of the party; or (b) by fax to their
last known fax number; or (c) by e-mail to the last notified e-mail address of the
party.
- 9.7 These terms and conditions shall be governed by and construed in accordance
with the laws of England & Wales and the parties submit to the non-exclusive jurisdiction
of the English courts.
